ORDER NO.FD-PR-21-34/2018 dated Lahore 14 December 2018 by a government of the Punjab finance department regarding Conveyance Allowance during Public Holidays for Punjab Teachers 2019 Finance Department.
WHEREAS Mrs. Allah Rakha and two other ESTs filed Writ Petition No.9379/2018 with the prayer that they may be granted conveyance allowance for the summer & winter vacations. Respondent No.2 May kind) be directed to decide the pending applications mentioned above posted by this court without any further delay.

2 AND WHEREAS the Lahore High Court. Bench. Bahawalpur vide order dates 28-10-2018 has remanded the writ petition to respondent No.02. Secretary Funding to extravagance it as depiction and choose the similar in agreement with rule inside the dated of 16-days.

AND WHEREAS the petitioners are civil servants and they belong to the vacation department i.e. School Education Department They are demanding Conveyance Allowance during summer and winter vacation. School Education Department was declared as a vacation department vide Civil Service Rules Vol-1 Part VI. Rule 8.60 read with Appendix 18. According to para 1.15(2) of ‘Punjab Traveling Allowance Rules (Compendium 2008)’, conveyance allowance falling under Rule 1.14(it will be admissible only for the period during which the civil servant held a post which a conveyance allowance is devoted and resolve not be permissible during leave or maybe joining time.
4 AND WHEREAS Conveyance Allowance; 5 a compensation to those employees who spend daily expenditure either to reach office or to go back home-. Whereas other teachers do not spend any amount to reach the office and vice versa during winter and summer vacation a

AND WHEREAS Finance letter dated 18-08-1977 decided that the Conveyance Allowance is not admissible during vacation, However, officers of the vacation department who are required to attend their official duties during vacation or part thermal) be entitled to draw Conveyance Allowance for such period during vacation is certified by the head of institution/department to have been spent on duty. This point was Wither clarified vide Finance Department’s letter dated 03.12.2013. Furthermore, after 18 amendments in the constitution of the Islamic Republic of Pakistan 1973. The Punjab Government is not bound to follow the policy of the Federal Government / other Provincial Governments.
Lahore High Court, Bahawalpur Bench Decision:
5. AND WHEREAS a personal hearing was afforded to the petitioners on 29.11.2018 as per directions of the Nonlife Lahore High Court. Lahore dated 26-10-2018. During the hearing, the petitioners reiterated their earlier request made in the writ petition.
6. In light of a policy of the Finance Department, all petitioners are not entitled to benefit as demanded in this writ petition. However, they are entitled to Conveyance Allowance for the period of vacation when they were required to attend their official duties subject to a provision of a certificate from the head of the institution/department, Therefore. I. Hamed Yaqoob Sheikh, Finance Secretary, after the petitioners perusing the available record of a policy circulated, hereby dispose of the application of the petitioners
