Regularization of contract, ad hoc employees stayed

Times News Network Chandigarh: The Punjab and Haryana high court on Friday stayed the Haryana government's policy to regularize the services of its contractual and ad hoc employees. The policy was framed by the former chief minister Bhupinder Singh Hooda-led Congress government as a populist move just ahead of state assembly elections in 2014. The court also made it clear that the fate of employees, who have been regularized under this policy, would be subject to a final decision on the petition in the court. A division bench headed by Justice Surya Kant passed these orders while hearing a bunch of petitions filed by Yogesh Tyagi of Sonipat district and others. The policy was challenged before the HC in August 2014, and since then the matter was pending. Initially, the state government had held back the implementation of policy but in June it decided to go ahead with the move. Aggrieved by the government's decision to implement the policy, the petitioners had approached the HC. The petitioners had been alleging that the state government, in order to gain political advantage in the Vidhan Sabha elections, was trying to lure the general public by offering the candies of regularization to contractual or ad hoc or similar temporary arrangements. It was also submitted that such a policy of the state government was against the constitutional provisions and various guidelines issued by the Supreme Court. Referring to a Supreme Court order in the case of Karnataka versus Uma Devi in 2007, the petitioners had also been arguing that a five-judge bench of the HC had directed all states that the services of employees, hired through the back door, could not be regularized. It was also contended that the apex court had made it clear that the government could not regularize the services of temporary staff without following the prescribed procedure. As per the amended policies brought by the Hoods government in 2014, the services of such contractual employees of various departments, who already had or would complete 10 years of service by December 31, 2018, were made eligible to be regularized.
